Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Elarge LLC ("we," "us," or "our") governing your access to and use of the StilUp mobile application and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your country, whichever is higher) to use the Service. By using the Service, you represent that you meet this requirement and that you are legally able to enter into these Terms.

2. Your Account

• You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
• You agree to provide accurate, current information and to keep it up to date.
• You must notify us immediately of any unauthorized use of your account.

3. The Service

StilUp lets you build a virtual closet, receive AI-generated outfit recommendations based on weather and occasion, view AI-generated preview images, and track feedback over time. Outfit suggestions are advisory; final styling decisions are yours.

4. Subscriptions, Credits, and Payments

• Where you pay. Paid features are sold as auto-renewing subscriptions or credit packs via Apple's App Store or Google Play. All charges are processed by Apple or Google according to their respective terms.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends. You can manage or cancel auto-renewal in your Apple ID or Google Play account settings.
• Credits. Outfit generation may consume in-app credits. Credits have no cash value, are non-transferable, and (except where required by law) are non-refundable once consumed.
• Refunds. Refund requests for App Store or Google Play purchases must be submitted through the respective platform. We do not directly process credit-card refunds.
• Price changes. We may change prices for new billing periods. Apple or Google will request your consent before charging a new price, as required by their policies.

5. Apple App Store Additional Terms

If you obtained the Service from the Apple App Store, you acknowledge that these Terms are between you and Elarge LLC, not Apple, and that Apple has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these Terms and may enforce them. Use of the Service must also comply with the Apple Media Services Terms and the Usage Rules of the App Store Terms of Service.

6. Google Play Additional Terms

If you obtained the Service from Google Play, your use is also subject to the Google Play Terms of Service. Google is not responsible for the Service or any claims arising from your use of it.

7. Your Content

You retain ownership of photos and other content you upload ("Your Content"). By uploading Your Content, you grant Elarge LLC a worldwide, non-exclusive, royalty-free license to host, store, process, transmit to AI providers, generate derivative outfit imagery from, and display Your Content back to you solely for the purpose of operating and improving the Service. You represent that you have the rights necessary to grant this license and that Your Content does not violate any law or third-party right.

8. Acceptable Use

You agree not to:

• Upload content that is unlawful, harassing, sexually explicit involving minors, hateful, infringing, or that you do not have rights to.
• Reverse-engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law.
• Use bots, scrapers, or automated tools to access the Service without our written permission.
• Interfere with the Service's operation, attempt to gain unauthorized access, or probe for vulnerabilities except through a coordinated disclosure to us.
• Resell, sublicense, or commercially exploit the Service or AI-generated outputs in ways prohibited by these Terms or applicable law.

9. AI-Generated Content

Outfit recommendations and preview images are generated by AI models and may contain inaccuracies or visual artifacts. We make no warranty that AI outputs will be accurate, fit you, or be suitable for any particular occasion. Use them as inspiration, not as a substitute for professional advice.

10. Intellectual Property

The Service, including its software, branding, designs, text, and graphics (excluding Your Content), is owned by Elarge LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continued provision becomes commercially unreasonable. Upon termination, your right to use the Service ceases, and we may delete your account data subject to our Privacy Policy.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELARGE LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.

14. Indemnification

You agree to indemnify and hold harmless Elarge LLC, its affiliates, and their respective officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Azerbaijan, without regard to its conflict-of-laws principles. The courts located in Baku, Azerbaijan will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory consumer-protection laws of your country of residence provide otherwise.

16. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you via the app or by email before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
